1. Who We Are

I Spy AI is a web-based AI image detection service available at www.ispyai.io and operated by Cira Tech LLC(“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, application, and services (collectively, the “Services”).

These Terms are available under a Creative Commons ShareAlike license, adapted from the Automattic Legalmattic open-source legal documents.

2. Acceptance of Terms

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services.

If you are using the Services on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms, and the word “you” refers to that entity.

3. Minimum Age

The Services are not directed to children. You must be at least 13 years oldto create an account. If you are located in the European Union or European Economic Area (“EU/EEA”), you must be at least 16 years old to use the Services without parental or guardian consent, in accordance with the GDPR. Users between the applicable minimum age and 18 may only use the Services under the supervision of a parent or legal guardian who agrees to these Terms on their behalf.

We do not knowingly collect personal information from anyone below the applicable minimum age. If we become aware that we have done so, we will delete that information promptly.

4. Your Account

To access the Services you must create an account. You agree to:

• Provide complete, accurate, and current information when registering and keep it up to date.
• Keep your password secure and not share your credentials with others.
• Take responsibility for all activity that occurs under your account.
• Notify us immediately at [email protected] if you suspect unauthorized access to or use of your account.

We reserve the right to reclaim, disable, or terminate accounts that violate these Terms or that have been inactive for an extended period, subject to applicable law.

5. Subscription and Billing

Paid Subscription

Access to image analysis features requires an active paid subscription. Subscription fees are charged on a monthly recurring basis. Current pricing is displayed at checkout before any charge is made.

Free Trial

New subscribers may be eligible for a 7-day free trial. During the trial period your subscription is active but you will not be charged until the trial ends. A valid payment method is required to start a trial. If you do not cancel before the trial ends, you will be charged the applicable subscription fee.

Payment Processing — Dodo Payments

All payments are processed by Dodo Payments as Merchant of Record. When you subscribe, your payment information is collected and handled directly by Dodo Payments under their Privacy Policy and Buyer Terms. We do not receive or store your full payment card details.

Automatic Renewal

Your subscription automatically renews at the end of each billing period at the then-current price unless you cancel before the renewal date. You can cancel at any time through your account or by contacting us. Cancellation takes effect at the end of the current billing period; you will retain access through that date.

Fee Changes

We may change subscription fees at any time. We will give you reasonable advance notice of any price increase before it takes effect. If you do not cancel before the new price takes effect, you consent to the new price. EU/EEA consumers will receive notice in accordance with applicable consumer protection law.

Taxes

Subscription fees are exclusive of applicable taxes unless stated otherwise. You are responsible for any sales, use, VAT, GST, or similar taxes applicable to your purchase.

Refunds

Payments are generally non-refundable except as required by applicable law or as set out in the EU/EEA right of withdrawal described in Section 14. If you believe a charge was made in error, contact us at [email protected].

6. Image Uploads and Analysis

The core feature of I Spy AI is the analysis of images to detect indicators of AI generation. By uploading an image you represent and warrant that:

• You own the image, have the rights holder’s permission to submit it for analysis, or have a lawful basis for doing so.
• The image does not contain child sexual abuse material (CSAM) or any other illegal content. Submission of such material will result in immediate account termination and mandatory reporting to law enforcement and relevant authorities.
• You are not using the analysis result to facilitate fraud, defamation, harassment, non-consensual intimate imagery, or any other unlawful activity.

We transmit your image to our analysis backend solely to perform the requested detection. Images are not retained after the analysis is complete. See our Privacy Policy for details.

7. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You represent, warrant, and covenant that your use of the Services:

• Will comply with all applicable local, state, national, and international laws and regulations.
• Will not infringe, misappropriate, or violate the intellectual property, privacy, publicity, or other rights of any third party.
• Will not involve the upload or transmission of any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Will not involve CSAM or any sexually explicit content depicting minors in any form whatsoever.
• Will not be for the purpose of creating, distributing, or facilitating deepfakes intended to defame, harass, defraud, or harm any individual.
• Will not attempt to probe, scan, or test the vulnerability of any part of our Services, or breach or circumvent any security or authentication measures.
• Will not involve the use of automated means (bots, scrapers, crawlers) to access the Services without our prior written consent.
• Will not interfere with or disrupt the integrity or performance of the Services or the data contained therein.
• Will not be used to send unsolicited or unauthorized advertising, promotional material, or spam.
• Will not involve reselling, sublicensing, or otherwise commercially exploiting the Services without our written authorization.

8. Illegal Use and Account Termination

Any use of the Services that violates applicable law — including but not limited to criminal law, intellectual property law, privacy law, data protection law, or laws prohibiting harassment, defamation, or the distribution of illegal content — is strictly prohibited and constitutes a material breach of these Terms.

Upon discovery of or credible report of illegal use, we reserve the right to:

• Immediately suspend or terminate your account and access to the Services without prior notice and without refund.
• Preserve and disclose relevant account information, usage records, and uploaded content to law enforcement agencies, regulatory authorities, or other competent authorities as required by law or as we reasonably determine is necessary to protect the rights, property, or safety of Cira Tech LLC, our users, or the public.
• Report the conductto the appropriate local, national, or international law enforcement or regulatory bodies, including (where applicable) reporting CSAM to the National Center for Missing & Exploited Children (NCMEC), Internet Watch Foundation (IWF), or equivalent authorities in your jurisdiction.
• Seek injunctive or other relief as permitted by law.

You acknowledge that the illegal use provisions of these Terms apply regardless of your jurisdiction, and that we will cooperate with law enforcement requests consistent with applicable legal requirements and our Privacy Policy.

9. Intellectual Property

Our Intellectual Property

The Services, including all software, design, text, graphics, and other content created by or for Cira Tech LLC, are owned by or licensed to Cira Tech LLC and are protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in the Services or our intellectual property.

Your Content

You retain all ownership rights to the images you upload. By uploading an image you grant us a limited, non-exclusive, worldwide, royalty-free license to use the image solely to perform the requested analysis and return a result to you. This license terminates when the image is deleted following completion of the analysis.

We do not claim ownership of your images, use them for any purpose other than analysis, or share them with third parties other than the analysis backend necessary to provide the Service.

Feedback

If you submit feedback, suggestions, or ideas about the Services, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use that feedback for any purpose, including improving the Services, without any obligation to you.

10. Third-Party Services

The Services integrate with third-party providers including Dodo Payments (billing), DigitalOcean (database hosting), and Gmail SMTP (email delivery). Your use of those providers is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party providers.

Links to external websites or services do not constitute our endorsement of those sites or services.

11. Changes to the Terms

We may revise these Terms from time to time. When we make material changes, we will update the date at the top of this page and, where required by law, notify you by email at the address associated with your account before the changes take effect.

For EU/EEA consumers, material changes will be communicated with reasonable advance notice, and continued use of the Services after that notice period constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you may cancel your subscription before the changes take effect.

For all other users, your continued use of the Services after revised Terms are posted constitutes your acceptance of the changes.

12. Termination

By you: You may stop using the Services and cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

By us: We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. In the event of termination for cause (including illegal use), no refund will be issued. In the event of termination without cause, we will provide a pro-rata refund of prepaid but unused subscription fees where required by applicable law.

Upon termination, all licenses granted to you under these Terms immediately cease. Sections that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — will survive.

13. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law.

We do not warrant that: (a) the Services will be uninterrupted, error-free, or secure; (b) any defects will be corrected; (c) the analysis results will be accurate, complete, or reliable for any particular purpose. AI-based detection is probabilistic and may produce false positives or false negatives. You should not rely solely on analysis results to make consequential decisions.

No Guarantee of Accuracy — Decision-Support Tool Only

I Spy AI is designed to assist you in evaluating whether an image may have been AI-generated. It is not a definitive or infallible detector, and results should never be treated as conclusive proof that an image is or is not AI-generated.

The underlying detection model is probabilistic. Results may include false positives (identifying a human-created image as AI-generated) and false negatives (failing to identify an AI-generated image). Accuracy varies depending on image type, generation method, post-processing, and other factors outside our control.

You are solely responsible for how you interpret and act upon any analysis result. I Spy AI is intended only as one input in your own independent evaluation process. Do not use analysis results as the sole basis for any consequential decision — including but not limited to employment, legal, editorial, academic, or financial decisions — without applying your own judgment and, where appropriate, seeking independent verification.

Cira Tech LLC expressly disclaims any liability arising from your reliance on analysis results without the exercise of your own independent judgment.

Nothing in this section limits statutory guarantees that cannot be excluded under applicable consumer protection law, including EU/EEA consumer rights or California consumer protection law.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Cira Tech LLC, its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Services, even if we have been advised of the possibility of such damages.

In no event will our total aggregate liability to you for all claims arising out of or related to these Terms or the Services exceed the greater of (a) the total fees you paid to us in the twelve (12) months preceding the claim or (b) fifty US dollars (USD $50).

Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under applicable law including mandatory consumer protection rights under EU/EEA law or California law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Cira Tech LLCand its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) your violation of any applicable law or regulation.

This indemnification obligation does not apply to EU/EEA consumers to the extent it conflicts with mandatory consumer protection law.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in California.

EU/EEA and UK consumers: The choice of California law does not deprive you of the protection of mandatory provisions of the law of your country of residence. EU/EEA consumers may bring claims before the courts of their country of residence and may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

California consumers: California residents may contact the California Department of Consumer Affairs, Division of Consumer Services at www.dca.ca.gov.

17. EU/EEA and UK Consumer Rights

If you are a consumer located in the European Union, European Economic Area, or United Kingdom, the following additional terms apply and, to the extent of any conflict with the general Terms above, will prevail.

Right of Withdrawal (14-Day Cancellation Right)

You have the right to withdraw from your subscription contract within 14 days of the date it was concluded (“withdrawal period”) without giving any reason, under the EU Consumer Rights Directive (2011/83/EU) and equivalent UK law.

If you request that the Services begin during the withdrawal period: By clicking “Subscribe” and starting an analysis during the withdrawal period, you expressly request that we begin providing the Services before the withdrawal period has expired. In that case, if you later exercise your right of withdrawal, you will owe us a proportionate amount for the Services provided up to the point of withdrawal compared to the total price of the subscription. If the Services have been fully performed within the withdrawal period, you lose the right of withdrawal.

To exercise your right of withdrawal before the Services begin, contact us at [email protected] with a clear statement of your decision to withdraw. We will refund any amounts due without undue delay and no later than 14 days after we receive your withdrawal notice, using the same payment method you used for the original transaction.

Conformity of Digital Services

We warrant that the Services will conform to the description provided and will be provided with reasonable skill and care. If the Services do not conform, you have rights under the applicable digital content / digital services directive in your country, which may include the right to have the issue remedied, a price reduction, or termination of the contract.

Unfair Contract Terms

Nothing in these Terms is intended to limit your rights under the EU Unfair Contract Terms Directive (93/13/EEC) or equivalent national legislation. Any term found to be unfair under applicable consumer law will not be binding on you.

GDPR and Data Protection

We process personal data of EU/EEA users in accordance with the General Data Protection Regulation (GDPR). Your data protection rights — including access, rectification, erasure, portability, objection, and the right to lodge a complaint with a supervisory authority — are described in our Privacy Policy.

18. California Consumer Rights

If you are a California resident, the following additional disclosures apply under California law, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), and the California Automatic Renewal Law (Business & Professions Code § 17600 et seq.).

Automatic Renewal Disclosure (California)

Your I Spy AI subscription will automatically renew each month at the then-current price charged to your payment method on file until you cancel. You may cancel at any time before the renewal date by contacting us at [email protected] or through your account settings. Cancellation takes effect at the end of your current billing period.

CCPA/CPRA Privacy Rights

California residents have the following rights regarding their personal information, subject to verification and applicable exemptions:

• Right to Know: the categories and specific pieces of personal information we collect, the purposes for which we use it, and the categories of third parties with whom we share it.
• Right to Delete: request deletion of personal information we have collected from you.
• Right to Correct: request correction of inaccurate personal information.
• Right to Opt-Out of Sale/Sharing: we do not sell or share your personal information for cross-context behavioral advertising.
• Right to Limit Use of Sensitive Personal Information: we do not use sensitive personal information beyond what is necessary to provide the Services.
• Right to Non-Discrimination: we will not discriminate against you for exercising any of these rights.

California Shine the Light

Under California Civil Code § 1798.83, California residents may request information about the categories of personal information we have shared with third parties for their direct marketing purposes. We do not share personal information with third parties for their own direct marketing purposes.

19. US Economic Sanctions

You represent and warrant that you are not located in, under the control of, or a national or resident of any country subject to comprehensive US economic sanctions (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine), and that you are not listed on any US government list of prohibited or restricted parties, including the OFAC Specially Designated Nationals list.

We reserve the right to restrict, block, or terminate access to the Services at any time, without notice, if we reasonably believe that continued access would violate applicable US export controls or sanctions law.

20. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Cira Tech LLC regarding the Services and supersede all prior agreements.
• Severability: If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be severed from these Terms, and the remaining provisions will continue in full force and effect.
• No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
• Language: These Terms were drafted in English. In the event of any conflict between a translated version and the English version, the English version will control.
